FOR AN AUTOMOBILE ACCIDENT:

  • Following an accident, the most important thing you can do to protect yourself is to copy down the license plate number of the other vehicle involved as well as getting the driver’s license information of the other driver. This includes their name, address, license number and expiration, telephone number and every piece of information on their insurance card.
  • Never accept cash or a promise from the other individual to repair the damage. 
  • Report the accident to the police and find out when and where the report will be available. Obtain the officer’s badge number and contact information as well.
  • Immediately obtain medical treatment if you are injured. Failure to obtain immediate medical treatment diminishes your claim that you suffered injuries as a result of the accident.
  • Take pictures of damages to all cars/property involved before any repairs or improvements are made. Take them from all angles to show the non-damaged sides too.  Take pictures of any skid marks and the surrounding areas too. When in doubt take a picture of it and let the attorney decide what can and can’t be used for your case.  Non-digital pictures from a disposable camera are better than digital pictures because digital pictures are susceptible to claims of alteration.
  • Take the vehicle for a repair estimate as soon as possible.  Try to get at least two estimates – one of which from the recommended facility the insurance company directs you to and one from another independent repair shop.
  • Take non-digital pictures of your injuries immediately. Pictures are an invaluable article of proof.
  • Take the name, address and telephone number of any potential witness and keep it with the accident report. Return to the accident scene, visit any nearby homes or business for any potential witnesses to the accident.  Let your personal injury attorney contact them for detailed statements.
  • Don’t make statements to any insurance company representative without consulting a lawyer. You do not know if they will be used against you later on.
  • Keep a list of all doctors, hospitals and treatment centers you visited as a result of any injuries.

FOR AN ANIMAL ATTACK: 

  • Obtain the name and address of the owner of the animal, if possible.  This information will be crucial to file a suit.
  • Take pictures of the location where you were bitten by the animal.  Non-digital pictures from a disposable camera are better than digital pictures because digital pictures are susceptible to claims of alteration.
  • Take non-digital pictures of your injuries immediately. Pictures are an invaluable article of proof.
  • Seek out medical treatment to make sure that you or your family member has not been infected with any disease.
  • Note the color, breed (if know) and approximate weight for animal control officers to conduct the search if the animal has ran off.
  • Make sure a report is filed with the animal control officer and obtain a copy of it.
  • Take the name, address and telephone number of any potential witness and keep it with the incident report. Return to the incident scene, visit any nearby homes or business for any potential witnesses to the accident.  Let your attorney contact them for detailed statements.
  • Keep a list of all doctors, hospitals and treatment centers you visited as a result of any injuries.

 FOR A SLIP AND FALL

  • Take pictures of location where you fell, including the floor surface, as soon as possible to capture the condition at the time of your fall.  Non-digital pictures from a disposable camera are better than digital pictures because digital pictures are susceptible to claims of alteration.
  • Save the shoes that you were wearing during the fall and place them in a plastic or other preserving bag.  Do the same with any clothing that you were wearing and do not wash them.
  • Save the article that you slipped on even if you have to freeze it (perishable food articles).
  • Make sure you have some sort of documented incident report filled out from the manager.  Do not leave the scene until you have this filled out in your presence.
  • Take non-digital pictures of your injuries immediately. Pictures are an invaluable article of proof.
  • Take pictures of all the surrounding areas to include your clothing and shoes.
